Terms & Conditions

1. UK Tram Limited (“UK Tram”) is a company limited by guarantee.

Its members include the following organisations:

      • Confederation of Passenger Transport UK
      • Light Rail Transit Forum
      • London Bus Services Limited
      • Passenger Transport Executive Group Limited

It was established to enable key public and private sector stakeholders in the UK tramway industry to present a unified front in dealing with government and statutory bodies in developing a co-ordinated and structured approach to regulation, procurement and standardisation within the industry.

These terms and conditions (“Terms and Conditions”) apply to the entire contents of the UK Tram website (the “Website”) and to any correspondence by e-mail between UK Tram and you. Please read these Terms and Conditions carefully before using the Website.

 

2. Use of UK Tram Website is governed by these Terms and Conditions

Your use of this Website constitutes acceptance of these Terms and Conditions. If you do not accept these Terms and Conditions in full, you must leave the Website immediately.

 

3. UK Tram may at any time revise these Terms and Conditions.

It is up to you to regularly review the Terms and Conditions in case there are any changes. Continued use of the UK Tram Website after a change has been made is to be treated as acceptance of that change by you.

 

4. Disclaimer.

Whilst UK Tram tries hard to ensure that the Website is functioning correctly and is normally available for 24 hours a day, UK Tram is not responsible if for any reason the Website is unavailable at any time for any period.
Access to the Website may be temporarily suspended and without notice in the case of failure, maintenance or repair or for any reason beyond UK Tram’s control.

UK Tram endeavours to ensure that the information on the Website is as accurate as possible although this may not always be achievable and the following disclaimer applies:
a) The Website is provided “as is” without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, compatibility, non-infringement, accuracy and security. UK Tram does not warrant the accuracy and completeness of the content on the Website. UK Tram may make changes to such material from time to time. UK Tram cannot guarantee that the material on the Website will always be accurate, complete or current or that access to the Website will be uninterrupted.
b) UK Tram expressly excludes all liability for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, special, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) occasioned from the use or inability to use the Website, whether directly or indirectly resulting from inaccuracies, defects, including but not limited to viruses that may infect your computer equipment, software, data, or other property on account of your access to, use of, or browsing the Website or your downloading of any material from the Website or any websites linked to the Website.
Nothing in these Terms and Conditions shall exclude or limit UK Tram’s liability for:

a) death or personal injury caused by negligence;
b) fraud;
c) misrepresentation as to a fundamental matter; or
d) any liability which cannot be excluded or limited under applicable law.

 

5. Links

The Website may contain links to third party websites over which UK Tram has no control. Such links are supplied solely for the convenience of users. UK Tram does not control and it is not responsible for these websites. UK Tram will not accept any liability for the contents or reliability of the third party websites and UK Tram does not endorse the views expressed within them or the organisations or persons providing them in any way. UK Tram does not guarantee the operability of these links and has no control over the availability of the linked pages.

If you as a website provider wish to link your website to the UK Tram Website, you may do so on the basis that:
a) such links do not open UK Tram pages into frames within a third party website;
b) pages from the UK Tram Website must be loaded into the user’s entire browser window;
c) you do not in any way imply that UK Tram is endorsing any products or services other than its own;
d) you do not link from a website that is not owned by you;
e) you do not misrepresent your relationship with UK Tram not present any other false information about UK Tram; and
f) the use of the UK Tram logo or the logos of any associated or subsidiary organisations must not be used for promotional or linking purposes unless prior approval in writing has been given.

Centro expressly reserves the right to revoke the right granted in paragraph 5 (b) for breach of these Terms and Conditions and to take any action it deems appropriate.

You shall fully indemnify UK Tram for any loss or damage suffered by UK Tram or any of its associated companies or organisations for a breach of paragraph 5 (b).

6. Intellectual Property Rights

Unless expressly stated the copyright and other intellectual property rights (such as, design rights, trade marks, patents etc) in any material on the UK Tram Website remains the property of UK Tram (or as the case may be another rightful owner). UK Tram owned material on the Website including text and images, may
not be printed, copied, reproduced, republished, downloaded, posted, displayed, modified, reused, broadcast or transmitted in any way, except for the user’s own personal non-commercial use.
Permission for any other type of use must be obtained from the Corporate Publicity Team on cpd@centro.org.uk.

7. General

These Terms and Conditions will be governed and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction over disputes between a user and UK Tram arising out of the access or use of these websites.

Omission by UK Tram to exercise any right under these Terms and Conditions will not constitute a waiver of such right unless expressly stated by UK Tram in writing.

These Terms and Conditions together with UK Tram’s Privacy Policy constitute the entire Agreement between UK Tram and you.
